Also used as collateral was an 1800-acre tract of land in Liberty County on Newport Swamp, bounded north by land of the heirs of Robert Bailey, west by land of Robert Quarterman, east by land of Thomas Bacon, and south by land of James Cochran. It had been purchased of Charles and William Mydleton [alt: Middleton].
It had been agreed between the two parties that the interest on the loan, which was to be repaid by 1799, would be paid in rice by delivery of 120 barrells of “good, clean, merchantable rice,” every February to Peter Spence in Charleston.
Witnessed by Roger Pinckney, Lewis Crouch Trezevant.
A codicil was added in which Peter Spence agreed that if Roger Parker Saunders “shall be obliged by war to remove the within mentioned Negroes from the plantation within mentioned,” then Saunders should only be required to deliver 100 barrels of rice annually during that time since he would be unable to occupy the property mentioned, but that deficiency was to be made up the year after such a war ended. He also authorized Roger Parker Saunders to “to sell any of the negroes within mentioned, who shall be have very much amiss,” as long as he mortgaged “others of equal value” in their place and got permission first from a majority of Spence’s attorneys.
This deed was said to be recorded in the South Carolina Secretary’s Office in Mortgage Book HHH, page 261, on April 20, 1791. Recorded in Liberty County Superior Court on July 2, 1791.
