Marriage Contract (Bacon/McIntosh)

Enslaved Persons Named: Tom, Hetty, George, Cook, Hannah, Doll, Sam, Lizzy, Dinah, John, Phoebe, Miley, Celia, L. Sam, Rachel

On October 12, 1836, Albert T. Bacon, Liberty County, and Anna Mariah McIntosh, also of Liberty County, entered into a marriage contract, with Charles West and Barrington King acting as her trustees. As part of the contract, McIntosh put the following into a trust: “the following named slaves viz Tom, Hetty, George, Cook, Hannah, and Doll, and also of an undivided portion of Twenty-one slaves, bequeathed by the last will of the late James Nephew Esqr to the children of the late Mr. Hamden McIntosh, which portion of slaves so bequeathed, will be divided after the marriage of the said Anna Mariah McIntosh.” Witnessed by Charles W. West, Sarah E. West, and Mary C. [or E.] Baker. Probated by Charles W. West on October 15, 1836.

Below this deed was written: “South Hampton 10th Januy 1837 at an appraisement and division had this day by us the undersigned of the Slaves alluded to in the within instrument the following slaves were drawn by Doctor Albert T. Bacon in behalf of his wife Anna Mariah viz Sam, Lizzy, Dinah, John, Phoebe, Miley, Celia, L. Sam and Rachel, valued at 5,450 00/100 dollars.” Signed by “qualified appraisers & dividers” Jos. Jones, Jno Dunwoody, Jas. S. Bulloch.

Also written below this deed: “Received Liberty County 25th April 1837 from B. King and Charles West Trustees in a marriage settlement with Mariah McIntosh / now Mrs. Bacon/ & myself Four hundred dollars in full for a negro woman named Affy said amount was received by me for George sold to Dr. King and now replaced according to said marriage settlement. Executed in October last and held by Doctor C. West and B. King for that purpose. I warrant and defend said negro woman from any claim whatsoever.” Witnessed by B.B. King and H.M. Stevens.

Below this deed: “Georgia, Liberty County } Know all men by these presents that I Albert T. Bacon, for and in consideration of the sum of four hundred dollars to me in hand paid by Doctor B B King the receipt whereof is hereby acknowledged, have bargained and sold and by these presents do bargain and sell unto the said Doctor B B King, the negro slave George to him the said King his heirs and assigns forever and the said Bacon to said King will warrant and forever defend the said negro slaves fromt he claim of himself his heirs executors & administrators & from the claim of all other persons whatever.” Witnessed by Eliza S. Stevens and E.H. Bacon, J.I.C.L.C. Signed by trustees A.M. Bacon and Charles West. Recorded in Liberty County Superior Court on May 20, 1837.
