Bill of Sale (Way/Way)

Enslaved People Named: Paul, Lizzie, Hagar, Peggy, Jim, Henry, Caesar, Cyrus & Tena [alt: Tenah]

On December 9, 1850, Nathaniel J. Way received a promissory note of $1775 from Edward F. Way to purchase “my portion being an undivided moiety of one half of the following negroes viz. Paul, Lizzie, Hagar, Peggy, Jim, Henry, Caesar, Cyrus & Tena [alt: Tenah]. Witnessed by S.S. Moody, Edwin White, Wm. F. Way. [NOTE: Marked on this deed was “Satisfied May 15th 1853. C. Hines.”] He committed to defend Edward F. Way against any claim against “said negroes” by his children Jane Augusta & Mary E. Caroline.

Subsequent to this deed was another deed: “Georgia, Liberty County } Know all men by these presents that I Edward F. Way (M.D.) of the County of Twiggs & State of Georgia am bound and firmly held to Nathaniel J. Way of Liberty County, Geo, in the just & full sum of $3500 to the true payment of which I bind myself, my heirs, exors & admors forever, sealed with my seal & signed with my hand and delivered this ninth day of December 1850. Conditioned however that whereas I have this day purchased the right, title & interest of said Nathaniel J. Way (being a moiety of one half) of the following negroes, viz. Paul, Lizzie, Hagar, Peggy, Jim, Henry, Caesar, Cyrus & Tena [alt: Tenah] and whereas I am about to remove said negroes from the county of Liberty & whereas a portion of said negroes may be claimed as the property of Jane Augustua & Mary E. Caroline children of said Nathaniel J. Way by his former wife Mary Caroline, now should any such legal claims be established & any decree of any Court be given, requiring the said children’s portion of said negroes to be returned to the County of Liberty & should I the said E. F. Way, return said portion of said negroes to the County of Liberty & deliver them to whomsoever may be authorized by said decree to receive them, then this bond or obligation to be null & void, otherwise to remain in full force & virtue.” Signed by E.F. Way. Witnessed by S.S. Moody, Edwin White, William F. Way. Recorded on December 12, 1850.
