Estate Settlement (Quarterman)

Enslaved Persons Named: Jim, Tenah, Chaney [alt: Chany, China], Miley, Mars, Lewis

On January 22, 1859, Jas. [James] S. McCollough, Trustee, received from Geo. [George] W. Walthour Executor of the estate of Thomas Quarterman the note of Thos. [Thomas] W. Quarterman for $800 to be paid the minors of Mary S. Hickman ”as left in the will of said Thomas Quarterman, also the note of Mrs. Sarah E. Quarterman Guardian of Axson Quarterman for the hire of negroes for the year 1858, being the portion of personal property drawn by said heirs also the said negroes Viz. Jim, Tenah, Chaney, Miley, Mars, and Lewis. Six in number drawn in lot no. 9 as will appear by appraisement and division.” Witnessed by T.W. Quarterman, J.P. Recorded on March 2, 1859, by S.A. Fraser, Clerk.

On February 21, 1859, James S. McCullough, “the substituted trustee under the will of Thomas Quarterman late of Liberty County deceased for Henry Hickman, Ruby Hickman and Mary Jane Hickman, minors of Mary S. Hickman, deceased of the first part,” noted that Thomas Quarterman’s last will and testament had left a certain portion of his property to Robert Y. Quarterman to be held in trust by him for the benefit of the aforesaid minors, and that either of the children of the Testator should have the privilege of purchasing the property falling to the said minors at the appraised valuation, with the money from this purchase to be held by the children’s trustee. He added that Robert Y. Quarterman had died before this trust could be executed, and that a decree by the Liberty County Superior Court had substituted him, James S. McCullough, as the trustee, in its November term 1858. During this same session, Thomas W. Quarterman had petitioned the equity side of the Court to authorize the Trustee to sell the property to him, as one of the Testator’s children, and it was so authorized. Thus James S. McCullough sold to Thomas W. Quarterman “the following negro slaves viz. Jim (commonly known as Jim Ward) also his wife Tenah, and her two children Chany [alt: Chaney, China] and Milly also Mars and Lewis, said slaves six in number being the slaves allotted to said minors under the said will” for $2900. Witnessed by Geo. [George] W. Walthour, A.S. Morrall, Jeremiah Baker. Recorded on March 2, 1859, by S.A. Fraser, Clerk.
