Marriage Settlement (Mary Ladson/Nathanial J. Varnedoe)

Enslaved People Named: Lucy and her two children, Matilda and Joe, Sary, Lydia and her three children, Sarah William Mary, Adeline and her child Andrew, James, Caroline, Peggy and Hester

On June 6, 1856, Joseph H. Ladson, Liberty County, filed an indenture between himself and John S. Roger, Chatham County, as parties of the first part, and Samuel M. Varnedoe, Liberty County and “substituted trustee” as the second part. He noted that a marriage settlement had been executed on March 20, 1850, between Mary A. Ladson, Chatham County, and Nathaniel J. Varnedoe, Liberty County, with Joseph H. Ladson, William I. Way, and John S. Rogers, Chatham County, as her trustees and that “the following named negro Slaves to wit Lucy and her two children, Matilda and Joe, Sary, Lydia and her three children, Sarah William Mary, Adeline and her child Andrew, and the future issue and increase of the said Female Slaves were conveyed unto the said Joseph H. Ladson, William I. Way, and John S. Rogers, upon certain uses and trusts therein contained.”

The document continued, “And whereas the following named negro slaves to wit Sary, Lydia and her three children Sarah William and Mary, Adeline and her child Andrew, being a part of those above enumerated and conveyed as aforesaid were sold and with the proceeds the following named negro Slaves, to wit James, Caroline, Peggy and Hester were purchased.” It stated that James, Caroline, Peggy and Hester were conveyed to Joseph H. Ladson and John S. Rogers as part of the marriage trust. 

It further stated that a decree of the April term of the Liberty County Superior Court in 1856 had substituted Samuel M. Varnedoe as trustee in the place of Joseph H. Ladson and John S. Rogers, William I. Way having never accepted, nor acted upon his appointment as trustee. Thus Ladson and Rogers conveyed to Varnedoe, as the new trustee, “the above named negro slaves, to wit Lucy and her two children Matilda and Joe, James, Caroline, Peggy and Hester.”
