Marriage Settlement (Thomas/Walthour)

Enslaved People Named: Windsor, Ben, Delia, Paine (?), Lindy, Joshua, Sam, Ellick, Abby, Scipio, Rose, Aleck, old George, old Kate, Nancy, Bess, Chloe, Mary (or Mary), Martha, Bess, Ellen, Delia, Linda, Isaiah, Richard, Charles, Embargo, and Rachel

On April 2, 1862, a marriage settlement was drawn up between Edward J. Thomas and Alice G. Walthour, with Wm. [William] Lounds [alt: Lowndes] Walthour and Russell Walthour as trustees, all of Liberty County. Given their impending marriage, and the “considerable real and personal estate” that Alice Walthour was likely to inherit, it was agreed that this future estate would be conveyed to Wm. Lowndes Walthour and Russell Walthour in trust for her. This estate consisted of “one house and lot in the village of Walthourville bounded north by lands of Est. Geo. W. Dunham, west by Academy lot, south by W.L. Walthour and east by lands of Dr. Howe, together with the appurtenances thereunto belonging, also promissory notes mostly secured by mortgages, the aggregate of principal amounting to the sum of fifteen thousand eight hundred and seventy six 95/100 dollars. Also five shares of stock in the Savh. A & G Rail Road amounting to five hundred dollars ($500) and the following named slaves Twenty eight in number viz. Windsor, Ben, Delia, Paine (?), Lindy, Joshua, Sam, Ellick, Abby, Scipio, Rose, Aleck, old George, old Kate, Nancy, Bess, Chloe, Mary (or Mary), Martha, Bess, Ellen, Delia, Linda, Isaiah, Richard, Charles, Embargo, and Rachel, together with the future issue and increase of the females above named, and all and such future estate as she the said Alice G. Walthour may become entitled to by inheritance or otherwise with the profits of all such present and such future Estate.” [NOTE: Conditions for inheritance of this after her death followed.] Witnessed by Wm. Curtis, K.A. Quarterman, Jno. H. Thomas. Probated by K.A. Quarterman on April 7, 1862, before Jno. B. Mallard, J.I.C.L.C. Recorded on April 22, 1862, by S.A. Fraser, Clerk.
