Used as Collateral (Winn to Winn)

Edmund, Joseph, Richard, James, Andrew, Johnson, Ann, Sophy, Rose, Lucy, Venus, Ellen, Eva, Patty, Peggy, Diana, Fanny, Sally, John, Tom, Young, Phillis, and Rachel, Tirah, John, Ida and Mary.

Edward Lawrence Winn used as collateral on an $18,000 bond to Ann Eliza Winn and Julia Virginia Winn ($9,000 each) on March 8, 1860 “the following negro slaves: Edmund, Joseph, Richard, James, Andrew, Johnson, Ann, Sophy, Rose, Lucy, Venus, Ellen, Eva, Patty, Peggy, Diana, Fanny, Sally, John, Tom, Young, Phillis, and Rachel with the future issue of the female slaves.” [NOTE: There was clearly a comma after “Young” and before “Phillis” but most likely it was a mistake and meant to be “Young Phillis”.] The debt was to be paid in tranches of $3600 each 11, 12, 13, 14, and 15 years after this date. If the debt was defaulted upon, agents for Ann Eliza and Julia Virginia would have the right to sell the slaves, with their future issue, “according to the provisions of the Act of the General Assembly,” and then return to Winn anything left after payment of $9,000 each with interest, charges, attorney’s fees and commissions for foreclosure. Witnessed by Abial Winn, R.Q. Stacy, Joseph Ashmore, J.P. Recorded on 19 May 1860 by Jesse Brewer, C.S.C.L.C.

In a separate indenture, dated March 8, 1860, Ann Eliza Winn and Julia Virginia Winn, of Liberty County, agreed to give up their share of their father Washington Winn’s estate to the other heir, Edward Lawrence Winn, Chatham County, in return for payment of $9,000 (each), except for “the house and lot in the village of Dorchester in said county, a carriage and horses, and the following negro slaves, Tirah, John, Ida and Mary.” Edward Lawrence Winn was also appointed the attorney for Ann Eliza and Julia Virginia and assumed the debts of Washington Winn’s estates, indemnifying Ann Eliza and Julia Virginia against any claims against the estate. Witnessed by Abial Winn, R.Q. Stacy, Joseph Ashmore, J.P. Recorded on 19 May 1860 by J. Brewer, Clerk.
