Transcription
I Thomas Mallard of the State of Georgia and County of Liberty, being of sound mind and memory do make my last Will and Testament as follows:
To my beloved wife Rebeca Eliza, I give and bequeath my driver man Joe, my three house women, Willoughby, Peggy and Henrietta, my man Windsor carriage driver, my carpenter man Pompey, together with his carpenter tools, my household, and kitchen furniture, my carriage & buggy, and carriage horses, my half of the house and lot in Dorchester, and one half of my stock of cattle and oxen, to her and her heirs.
To my daughter Mary Emeline I give and bequeath my negro woman Mary, to her and her heirs.
To my son Thomas Samuel I give and bequeath my negro man Hurcules [alt: Hercules], to him and his heirs.
To my son Cyrus Stevens children, I give & bequeath my negro man Daniel, to them and their heirs.
To my [son] Lazarus John I give and bequeath my negro man Stepney, to him and his heirs.
To my daughter Harriet Newell I give and bequeath my negro woman Drusilla, to her and her heirs.
To my daughter Rebeca Louisa I give and bequeath my negro woman Matilda and her little daughter Ellen, to her and her heirs.
To my daughter Ann Eliza I give and bequeath my negro woman Tyrah [?], to her and her heirs.
To my son Robert Quarterman I give and bequeath my negro man James, to him and his heirs.
To my beloved wife Rebeca Eliza and my children Mary Emeline, Thomas Samuel, Cyrus Stevens’ children and their mother, Lazarus John, Harriet Newell, Rebeca Louisa, Ann Eliza, Robert Quarterman and my grand daughter Sarah W. Mallard, I give & bequeath the remainder of my estate both real & personal to be equally divided between them share and share alike to them and their heirs.
It is my will and desire that the negroes I loaned to my children at their marriage together with their issue be considered a part of my estate to be divided, not including the negroes I have now given in legacy to my children.
I make, ordain, constitute and appoint my wife Rebeca Eliza executrix, my step son and friend Wm. S. Baker and my sons Thomas Samuel , Lazarus John and Robert Quarterman executors of this my last will and testament, ratifying and confirming this and no other to be my true last will and testament.
In witness whereof I have hereunto set my hand and seal this nineteenth (19th) day of August in the year of our Lord one thoursand eight hundred and fixty six, 1856.
