Will Summary (published 1964)
Martha Carter of Liberty County. Last Will and Testament dated April 18, 1823, probated July 7, 1823. Gives a slave to her grand-niece, Amanda Mara. Remainder of estate received by the will of her late husband James Carter, she gives to Joseph Law, Sr., and Thomas Mallard in trust for the use and benefit of her nephew William C. Way and niece Eveline Dunham, and if they die without issue then to her beloved great-nephew James C. Mara and great-niece, Sarah Amanda Mara. Executors: Joseph Law Sr., Thos. [Thomas] Mallard. Witnesses: Samuel S. Law, James Lambright, James Shannon.

[NOTE: The estate willed to Joseph Law Sr., and Thomas Mallard in trust for her nephew and niece included unnamed “negroes.” She added, “It is further my will and desire that the negroes be kept together on the plantation where they now are, unless one of both of the parties should marry, and wish a division, which shall take place only with the consent, and at the discretion, of the Trustees.]
