Bequests:
After debts are paid, he gives all of his personal estate to his wife and two children, and to the widow and two children of his deceased son James Audley as follows:

To his wife he gives one fourth part .

To his son Joseph Edward he gives one fourth part.

To his daughter Julia Rebecca King he gives one fourth part.

To the widow and two children of his deceased son James Audley – Susan M., Laura Elizabeth, and Charles Edward – he gives the remaining fourth part to be equally divided among them.
He gives his real estate as follows:

To his son Joseph Edward he gives “two tracts of land adjoining containing in the aggregate 714 acres, “one tract of land containing 621 acres called “Yellow Bluff” purchased of the estate of Thomas F. Bacon (Col. Island) and bounded north by lands of James F. Baker and south by lands apportioned by this will to my daughter Julia Rebecca King. Also a tract containing 93 acres purchased of estate [of] Thomas F. Bacon, having “Yellow Bluff” on the east. See plats of the above tracts representing resurveys made by Robert Hendry Jun. D.S. completed February 20, 1819.”

To his daughter Julia Rebecca King he gives “the following tracts of land containing in the aggregate 707 acres viz one tract originally granted to Thomas Perkins for 100 acres but containing by resurvey 110 acres, one other tract granted Thomas McGee for 100 acres but containing by resurvey 119 acres, also a tract containing by resurvey 174 acres purchased by me from Capt. John S. Quarterman. See a plat of the above tracts representing a survey completed by Robert Hendry Jun. D.S. Feb 12, 1819. I further give and bequeath unto my daughter Julia Rebecca King a tract of land formerly owned by Jos. Winn and Thos. [Thomas] Mell Jun. containing 43 acres, of which 20 acres were purchased by me from Thos. Bacon, 11 ½ acres at Sheriffs sale as the property of Thos. S. Mell and the remaining 11 ½ acres from Benjamin Mell Jun. See a plat representing in part a survey made at the request of Mr. Thos Mell by Wm [William] Cundiff C.S. July 21st 1801. Also a tract containing 50 acres originally granted to John Winn. [One word] titles to this tract executed to me by William Fleming, Wm W. Baker & Wm. A Cassels representatives to the heirs of the said John Winn deceased. One tract of 20 acres (more or less) adjoining the above tract purchased by me of the representatives to the heirs of Peter Winn deceased. Also one other tract of land containing 191 acres joining lands given by this will to my son Joseph Edward purchased of the estate of Thos. F. Bacon. I further give and bequeath unto my daughter Julia Rebecca King (two lots) in the town of Sunbury (L.C.) known and distinguished in the plan of said town by Nos 3 and 4.”

To Laura Elizabeth and Charles Edward, the children of his deceased son James Audley, he gives “four several tracts of land all adjoining containing in the aggregate 577 acres viz. One tract containing 150 acres being one half of a tract of 300 acres purchased by me of the Rev. William McWhir, one other tract containing 137 acres with the improvements thereon comprising part of a tract of 250 acres originally granted to John Barnaby, a tract originally granted to Mary Author for 200 acres but containing by resurvey 227 acres including 5 acres sold off to Col Joseph Law on the Half Moon Bluff. See plats of the two last named tracts representing surveys made by Robert Hendry Jun. D.S. On the 13 & 15 days of Feb. 1819. Also a tract of 68 acres purchased by me from the Est. [of] Thomas F. Bacon and joining lands given by this will to my daughter Julia Rebecca King. See plat of last named tract representing part of a resurvey for Thom. F. Bacon completed Feb 20 1819 by Robert hendry Jun. D.S. “
Further wills that his wife, should she survive him, shall have the following privileges during her natural life, “anything contained herein to the contrary notwithstanding”: the use of his present dwelling with both the household and kitchen furniture, as much land on the plantation bequeathed to his grandchildren Laura Elizabeth and Charles Edward as she needs for such slaves as she may inherit in the division of his estate to cultivate, and the use of his carriage and pair of horses.
He also gives his wife “the servant girl Grace “now about the house” to be included in the one fourth part of his personal estate that he bequeathed to her.
