Sale of Runaway Named Simon (1853)

…

Whereas it has been reported to this Court by the Sheriff of Liberty County that a negro man named Simon was taken up in the month of May of last year and whereas the said Negro man Simon has been lodged in the jail of said county for the space of twelve months during which time he has been legally advertised in the Savannah Milledgeville and New Orleans papers and no owner having called for the said Negro

Therefore be it ordered in conformity with the statues in such cases made & provided that said negro man be levied on by the sheriff advertised & sold agreeably to Law.

Whereas John M. Hendry of Alachua County, E. Florida, hath this day filed his affidavit that a certain negro man slave who gives his name as Simon now confined in jail and who has been levied on and advertised by the Sheriff of said County by virtue of an order of the Inferior Court to be sold on this day as a runaway slave, is to be the best of his knowledge and belief the property of Robert H. Howren of Madison County, Florida. Ordered that the Sheriff do postpone the sale of said negro slave Simon until the first Tuesday in July next in order to give said Robert H. Howren an opportunity to come forward & prove said slave according to Law.

It appearing to this Court that there are funds in possession of the clerk or Treasurer received from the Sheriff by the sale of a certain negro boy named Simon who was imprisoned in this County and advertised for twelve months and sold for the net sum of five hundred and ninety two dollars & nine cents after deducting expenses etc and the time having expired for owner of said negro to come forward and claim said funds, it is hereby ordered that the same be appropriated to county purposes.
