In the Name of God Amen, I John Timmons of Liberty
County in the State of Georgia being indisposed in Body
but of Sound Mind and Memory, Calling to Mind my
Mortality and knowing that it is Appointed for all men Once
to die, do make and Ordain this to be my last Will and
Testament, in Manner and form following, Committing my
Soul into the hands of god that gave it, and my Body to the
Earth to be Burried [sic] at the Discretion of my Executors
First that all my Lawfull debts and funerall Charges be
paid, then I give my worldly Estate in Manner following
Item I give to my Beloved Wife Maacah [alt: Maacha] a Childs part of all my
Estate both Real and Personall during her Naturall Life, and
after her death to be Equally Divided Between my Son Zachariah
and Daughter Elizabeth and Daughter Rachel, to them and
their Heirs forever –
Item I give to my Daughter Mary Myers One Negro fellow
Named Ceaser [alt: Caesar], which I had Before given her by a Deed
of Gift, to her & her heirs forever –
Item I give all the Rest of my Estate Both Real & Personall to my
four Youngest Children, that is to say, My Sons Richard
and Zachariah, & Daughters Elizabeth & Rachel to be
Equally Divided between them, I give to them, & to their
Heirs forever –
I Constitute, Nominate and Appoint My Beloved Brother
Richard Timmons & My Friends Josiah Bacon and
John Mitchell Junr Executors of this my last Will and
Testament, & Pronounce & Declare this to be my last
Will & Testament in presence of
