The Indenture, made this eleventh day of March in the year of our Lord one thousand eight hundred and thirty three, and of the Independence of the United States of America the fifty seventh, Between Thomas Mallard, of the County of Liberty and State aforesaid, Executor of the last will and testament of Joseph Hargreaves, late of the said State and County, deceased, of the one part, and Joseph Jones, of the same State and County, planter, of the other part, Witnesseth that by virtue of and conformity to a decree of the Superior Court of said County, rendered in the term of December in the year of our Lord eighteen hundred and thirty two, he the said Thomas Mallard did duly and legally advertise for sale in one of the public gazettes of the Eastern District of said State, and at the door of the Courthouse of said County, an undivided moiety of a tract of land containing three hundred and thirty acres, more or less, situate lying and being in said County, on Bulltown Swamp, bounded by lands of louis LeConte and Andrew Maybank, and Sullivan (now owned by William Hughes). And he the said Thomas Mallard, executor as aforesaid, on the first Tuesday in March in the year aforesaid, between the legal hours of sale, and in conformity [to] law, and his said advertisement, did put up and expose to public sale, to the highest bidder, at the door of the Courthouse of said County all the claim, right, title and interest of the estate of Joseph Hargreaves decreased in and to one hundred and sixty five acres of land, being undivided moiety of the tract of land containing three hundred and thirty acres before describe, when the same was knocked off to the said Joseph Jones at the price or sum of thirty one dollars; he being the highest and best bidder for the same. Now, for and consideration of the said sum of thirty one dollars to him the said Thomas Mallard in hand well and truly paid by the said Joseph Jones, at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, he the said Thomas Mallard, executor as aforesaid, Hath granted bargained and sold, and by these presents Doth grant, bargain and sell, unto the said Joseph Jones, all the right, title, interest and claim whatsoever of the said Joseph Hargreaves deceased in and to the said undivided moiety or half of a tract of land containing three hundred and thirty acres, being one hundred and sixty five acres of the same, with all the improvements and appurtenances thereunto belonging, or in any wise appertaining unto him the said Joseph Jones, his heirs and assigns, to his and their own proper use, benefit and behoof forever. And the said Thomas Mallard, executor as aforesaid, the right and title of the said Joseph Hargreaves deceased in and to the before mentioned moiety of three hundred and thirty acres of land, with all the improvements and appurtenances thereunto belonging, or in any wise appertaining, unto him the said Joseph Jones, and his heirs and assigns, will warrant and forever defend against himself, and against all other persons claiming the same by any title from the said Joseph Hargreaves decreased, as far as in law or equity, or by the decree of the said Superior Court, he may be bound to do, as executor aforesaid.
