Joshua H. Hargreaves vs Thomas Mallard Exor [Executor] of Joseph Hargreaves

In Equity.
This case coming on to be heard upon bill, answer, replication and exhibits, It is ordered and decreed, that the Complainant, Joshua H. Hargreaves, is entitled to the three fourths of the estate, real and personal, devised to him by the said will of Joseph Hargreaves. We also decree that as the said Shadrach under the laws of the State, being incapable of taking the other fourth of the estate devised to him by the said will, that the said Joshua H. Hargreaves, as the devisee over, is entitled to the same. We also order and decree, that the executor Thomas Mallard, as executor, is indebted to the said Joshua H. Hargreaves, as the sole and general devisees in the sum of fifteen hundred and fifty three dollars twenty four cents on the 3d. September 1832. We also order and decree, that the sum of fifteen hundred and fifty three dollars 24/100 be paid by the said Thomas Mallard executor to the said Joshua H. Hargreaves on the first of March 1833: that the said slaves contained in the inventory be delivered by the said executor to the said Joshua H. Hargreaves, Complainant on the first of January next; and that the real estate of the testator be sold, on the first Tuesday in March next, by the said executor, and the proceeds paid over to the said Joshua H. Hargreaves, Complainant.

In conformity to the within decree, I have this day received of Thomas Mallard Esqr [Esquirer] Executor of the last will and testament of Joseph Hargreaves deceased, the negro slaves directed by the said decree to be delivered by him to the within named Joshua H. Hargreaves. Witness my hand this second day of January eighteen hundred and thirty three.

In conformity to the within decree, I have this day received of Thos. [Thomas] Mallard Esqr [Esquirer] Executor, fifteen hundred and fifty three 24/100 dollars, being the amount in his hands on 3? September last, and eleven hundred and eighty one dollars, being the proceeds of the real estate on Bull Town Swamp and the Plantation in the occupation of the late Mr. Hargreaves.
Witness my hand this twenty first day of March eighteen hundred and thirty three.
