Enslaved Persons Named: Leah, Prime, Jacob
On February 1, 1840, the executors of John Lambert’s estate (Thomas Mallard, John Dunwody, Wm. Q. Baker, Ezra Stacy and William Jones) sold to Thomas W. Fleming, also of Liberty County, for $1136 “the following named Slaves, with the issue of the females to wit: Leah, Prime, and Jacob.” The executors cited the right to sell Lambert’s estate given them by an Act of the Georgia Assembly. Witnessed by B.A. Busby, S. Spencer, J.I.C.L.C. Recorded on April 11, 1840, by E. Way, Clerk.
On the same day, Thos. [Thomas] W. Fleming and Wm. [William] B. Fleming used as collateral on a promissory note to the executors of John Lambert’s estate (Thomas Mallard, John Dunwody, Wm. Q. Baker, Ezra Stacy and William Jones) “the following named slaves with the issue of the females to wit: Leah Prime and Jacob, also Phebe Rosannah and Bristol.” Witnessed by B.A. Busby, S. Spencer, J.I.C.L.C. Recorded on March 24, 1840, by E. Way, Clerk. [NOTE: Written on this deed was “Satisfied 1st March 1857 E. Stacy. Acting Exor Est. Lambert. Recorded 4 March 1851. J.S. Bradwell, Clerk.”
[NOTE: It is likely that Thomas W. Fleming bought Leah, Prime and Jacob from the Lambert estate on credit, and that William B. Fleming acted as security for the mortgage. It is not clear whether Phebe, Rosannah and Bristol were sold by the estate. Since they were not mentioned in the deed of conveyance, it is possible that they were already owned by Thomas W. Fleming (or William B. Fleming) and that for some reason the executors required that they be added to the mortgage for security.]
