Quoted in full for better understanding of the disposition of the estate of John Lambert: “Georgia, Liberty County } This indenture, made this first day of February Eighteen hundred & forty between Thomas Mallard John Dunwody Wm. [William] Q. Baker Ezra Stacy & William Jones Executors of John Lambert & their successors of the first part, and William Spencer of the said County & State of the second part; whereas by an act of the general assembly of the State of Georgia pass [SIC] on the twenty eighth day of December eighteen hundred & thirty eight it was enacted that the executors of John Lambert Deceased formerly of Liberty County Georgia be & they are hereby authorised to sell the whole of the Estate of their Testator both real & personal & vest the fund arising therefrom in stocks or such other property as in their discretion they deem best; due regard being had by them in making this substitution to the intention of said deceased in his will; Now this indenture witnesseth that in pursuance of said authority & under & by virtue thereof We Thomas Mallard John Dunwody Wm. Q. Baker Ezra Stacy and William Jones Executors of John Lambert deceased formerly of Liberty County Georgia, for and in consideration of the sum of nine hundred & fifty Dollars to us in hand paid at & before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold & conveyed & by these presents do grant bargain sell & convey unto William Spencer his Heirs and assigns, all the right title & interest of John Lambert our Testator and all the right title & interest which we his Executors under the said act of the general assembly of the State of Georgia can or have a right to grant bargain sell or convey to and in the following named Slaves with the issue of the females to wit, Isaac & Judy, to have and to hold said Slaves with the issue of the females to him the said William Spencer his heirs and assigns to the only proper use benefit & behoof of the said William Spencer, his heirs & assigns forever. Witness our hands & seals this first day of February eighteen hundred & forty.” Witnessed by W.E.W. Quarterman, S. Spencer, J.I.C.L.C. Recorded on March 4, 1840, by E. Way, Clerk.
