Marriage Settlement (Maxwell/Buttolph)

Enslaved Persons Named: Tripporah, Rachel, Major, Betty, Isaac, Joephinny, Jenny, Cato, William, Minor, Ben, Sawney Senior, Susan, Sawney Junior, Brister, Abram Junior, Jacob Senior, Jacob Junior, Sarah Minor, Dianna, Leah, Moll, Stephen, Primus Senior, Bella, Cate Major, Louis, Clarrissa [alt: Clarissa], Cretia, Robbin, Abram Senior, Nat, and John.

On June 10, 1856, Laura E. Maxwell contracted a marriage settlement with her intended husband David L. Buttolph in which Buttolph gave up any right to or interest in specified property owned by Laura Maxwell in her own right or any property she might acquire. All this property, which included named slaves, was to become a separate estate not subject to Buttolph’s debts or contracts. The property was put into a Trust to be managed by Charles C. Jones, Jr., I.A.M. King, and Joseph Jones, to be managed for Laura Maxwell’s benefit. Provisions were made for each party’s death. The property was comprised of land [which was fully described] and “the following named negro slaves to wit Tripporah, Rachel, Major, Betty, Isaac, Joephinny, Jenny, Cato, William, Minor, Ben, Sawney Senior, Susan, Sawney Junior, Brister, Abram Junior, Jacob Senior, Jacob Junior, Sarah Minor, Dianna, Leah, Moll, Stephen, Primus Senior, Bella, Cate Major, Louis, Clarrissa [alt: Clarissa], Cretia, Robbin, Abram Senior, Nat, and John.” Witnessed by C.C. Jones, Abial Winn, and Thos. [Thomas] W. Fleming. Probated by Thomas W. Fleming before S.A. Fraser, C.S.C.L.C., on June 21, 1856, and recorded by Fraser on June 21, 1856.
